If it can happen in Port Colborne, we have to believe that a similar disaster could happen in Thorold. This tragic story should serve as a wake-up call for a certified fire safety plan by all building owners.
A fire code violation conviction to the owner of 53 Nickel Street in Port Colborne was announced in court on July 18, 2018. The conviction was based on two counts in Provincial Offences Court for failing to comply with the Ontario Fire Code. A co-owner of the property, Nelly Engelage, was fined $100,000. Additionally, a victim surcharge of 25 percent was applied, in accordance with the provisions of the Fire Protection and Prevention Act.
In a media release by the City of Port Colborne, we learned about the disaster on December 14, 2016 when the local fire fighters responded to a reported structure fire. Responding crews found the dwelling to be fully involved on arrival.
Four occupants of the dwelling died that day. The investigation showed that the owner of the house failed to maintain the smoke alarms and test the smoke alarms annually.
“This tragic event will have an everlasting effect on the families, friends and emergency response personnel involved, as well as our community as a whole,” said Port Colborne Fire Chief T. Cartwright. “Our community must make every effort to live a fire safe life.”
All residents and landlords of buildings are reminded of their legal responsibilities. Smoke and carbon monoxide detectors must be installed and maintained. Failing to meet these requirements could result in fines up to $50,000 per count.
